Lagos Government Says No Criminal Action Can Be Taken Against Simi Without Formal Complaint

Lagos Government Says No Criminal Action Can Be Taken Against Simi Without Formal Complaint

The Lagos State Government has clarified that it cannot initiate criminal proceedings against popular Nigerian singer Simi over allegations circulating online, as no formal complaint has been filed by any alleged victim.

The statement came from Lola Vivour-Adeniyi, Executive Secretary of the Lagos State Domestic and Sexual Violence Agency, during an appearance on Morning Brief on Channels Television on Thursday. She emphasized that without a survivor or direct complainant coming forward, prosecution would be extremely difficult.

The controversy erupted after old social media posts linked to Simi, reportedly from 2012, resurfaced online. Users claimed that some of the posts contained statements about children at her mother’s daycare, which were widely criticized as inappropriate. Public attention intensified after Simi commented on sexual assault issues in Nigeria following false rape allegations made by TikToker Mirabel.

Simi responded to the resurfaced posts, explaining that she made them at age 23 while assisting at her mother’s daycare center. Despite her explanation, some social media users demanded government intervention. In response, the National Agency for the Prohibition of Trafficking in Persons (NAPTIP) stated on Instagram that it would investigate any credible report brought to its attention, urging anyone with direct evidence or personal knowledge to come forward.

Vivour-Adeniyi also suggested that the Ogun State Government, where the alleged incidents were said to have occurred, conduct a preliminary check. She highlighted that authorities have a duty to investigate claims appearing in the public space, but legal action cannot proceed without proper documentation and a formal statement from an affected individual. She said:

"As for the Simi case, we cannot pretend that we have not seen these reports. We have a duty to at least begin a preliminary investigation. The truth is that it will be very difficult to prosecute without a survivor being present."

Opinion: The Importance of Procedure Amid Public Pressure

The Simi controversy underscores the tension between social media outrage and the legal system. While online platforms amplify public concern and hold figures accountable, formal legal processes remain crucial to ensure fairness, due process, and evidence-based action.

Authorities are right to stress that prosecution requires a direct complainant. Without proper reporting, claims risk remaining unverified, and individuals may be unfairly judged in the court of public opinion. Social media discussions can influence narratives, but they cannot replace documented legal procedures.

This situation also highlights a broader lesson: if anyone has credible evidence of misconduct, reporting through the proper channels is essential for justice to be pursued. For public figures like Simi, transparency and timely explanations—like her acknowledgment of the past posts—can help manage misinformation, but only formal investigations can provide definitive closure.

In the end, while the public discourse may be heated, the rule of law must guide action, ensuring that both potential victims and the accused are treated fairly.
