SERAP Is Taking INEC To Court Over What A Donor Can Legally Give

SERAP has sued INEC at the Federal High Court in Abuja, in suit number FHC/ABJ/CS/2114/2026, over the commission's failure to disclose limits on political contributions under section 91 of the Electoral Act 2026. It is asking for an order of mandamus compelling INEC to say whether limits exist, what they are, and how they are being enforced ahead of 2027.
The organisation wrote to INEC in August. This is what happened when nobody answered.
The question is narrower than it sounds, and worse
This is not an allegation that anybody has broken a spending limit. It is a request to be told what the limit is. Section 91 gives the commission the power to prescribe contribution ceilings, and the suit asks whether that power has been used and, if it has, why parties, candidates, donors and voters have not been informed.

The campaign runs to January. A ruling will take longer than that.
Nigeria does not lack campaign finance law. It lacks a published number and somebody whose job it is to check.
The second SERAP case against INEC this month
Nine days ago the same organisation gave the commission seven days to account for 126.46 billion naira from the Auditor-General's 2023 report. That deadline has passed. INEC is now defending one demand about how it spent public money on the last election and another about how it regulates private money in the next one, in the same month it published the ballot for 2027.
