Prosecutors Say The Poco Lee Case Is Still Live

The Crown Prosecution Service has confirmed that the sexual offence case against the dancer Iweh Odinaka, known as Poco Lee, remains active, despite the widespread reports that he had regained his freedom. He is due at Snaresbrook Crown Court on Tuesday 15 September for a plea and trial preparation hearing.
He faces five charges: attempted rape, two counts of rape and two counts of assault by penetration.
What the release reports actually got wrong
Not necessarily the fact of a release. Bail, or a variation of conditions, is ordinary at this stage of a Crown Court case and is not an outcome. What was wrong was the implication, carried by more or less every outlet, that the case had ended.

Why the CPS, not the complainant, decides
In England and Wales a prosecution belongs to the Crown, not to the person who made the complaint. A complainant can stop cooperating and the CPS can still proceed. It can also discontinue for reasons it never explains publicly. This is the single most misreported feature of English criminal procedure in Nigerian coverage, and it is why "she dropped the case" is almost never an accurate sentence.
A plea and trial preparation hearing is the start of the formal process, not the end of it. Tuesday is a date in a case, not a verdict.
What Tuesday will and will not establish
It will establish a plea and a timetable. It will not establish guilt or innocence, and nothing before a trial does. Both the man accused and the person who made the complaint are entitled to have that distinction held, and the last week is a demonstration of what happens when a national news cycle decides it does not need documents.
